Q: How do I know if it is worthwhile consulting a lawyer – I may get better?

It is true that immediately after an accident, you do not know if your condition will improve. However, there are strict time limits for making a claim. For motor vehicle claims, these time limits commence only 9 months after the accident. It is worth lodging a claim in order to protect your time limit and we can discuss with you how we can help you based on the progress of your injury.

Q: How long does my employer need to keep my job open?

This depends on the nature of your claim, whether it occurred at work and whether you are likely to be able to return to work. It is illegal for an employer to terminate your employment merely because you have an injury or you have made a claim for compensation. However, your employer can, in some circumstances, terminate your employment if you have not been able to produce medical clearance to return to work. We can provide you with further information based on your specific circumstances.

Q: How will I pay my living expenses while I am waiting for the claim to resolve?

This will depend upon the nature of your claim, however:- • You may be entitled to WorkCover statutory benefits to replace your income. • You may be entitled to release of your superannuation benefits. • You can claim income protection or trauma insurance if you have a policy in place as well as seek damages for negligence. If none of the above options are available to you, you should apply for Centrelink benefits as soon as possible, you may be entitled to sickness benefits or a disability support pension.
